The Alliance for Critical Scholarship in Solidarity is a platform by and for people working in universities, research and cultural institutions. It develops infrastructures to protect academic freedom and university autonomy.
In recent years, academic discourse has faced growing hostility, while research has increasingly had to defend itself against external interference. Members of universities, research and cultural institutions are experiencing more and more intimidation and public defamation. This endangers universities as places for science-based, controversial and pluralistic debates.<\/p>\\n

In the face of these developments and the strengthening of right-wing extremist parties and positions, the alliance provides collectively developed resources to strengthen democratic procedures and to defend fundamental rights \u2013 including networking among individuals and exchange with academic and civil society institutions and organizations, peer counseling, compiled information resources, advocacy and public relations work for academic freedom, and the documentation of repression.<\/p>\\n

The alliance relies on the commitment of its members to create a network of solidarity that leaves room for the heterogeneity of political positions as well as for the diverse cultures of different fields of study. The alliance sees itself as an autonomous organization, critical of discrimination, advocating for intersectional approaches and the dismantling of academic hierarchies. In resistance against the securitization of universities and carceral logics, the discrediting of empirical knowledge and the vilification of fields of teaching and research, as well as the exclusion and disadvantage of vulnerable individuals and groups, the alliance practices critical scholarship in solidarity.<\/p>\\n

The Alliance for Critical Scholarship in Solidarity is open to members of universities, research and cultural institutions, as well as to individuals from other fields of work that are committed to the goals of the association (\u2198 statutes<\/a>). Students can become members in exceptional cases.<\/p>\\n

The \u2198 working principles and statutes form the basis of our cooperation. Members commit to acting in accordance with these principles and the statutes.<\/p>\\n

The Alliance for Critical Scholarship in Solidarity is based on the active participation and collective responsibility of its members and invites them to participate in existing working groups or to establish new ones as needed.<\/p>\\n

About the Alliance

The Committee for Concerns is responsible for conflict prevention and mediation in cases of conflict. It consists of the Ombudspersons and the Awareness Team. We are writing to you in the name of the Alliance for Critical Scholarship in Solidarity<\/a> (KriSol). The Alliance was founded in response to the growing repression against critical scholarship in Germany, Austria and Switzerland as well as elsewhere. Its members encompass academics, artists, and lawyers. We advocate for emancipatory and critical teaching and research that facilitate open debates in institutions of higher education and beyond.\u00a0<\/p>\\n

Given this remit we are very alarmed by the \u201cCode of Conduct of documenta and Museum Fridericianum gGmbH\u201d which was published on 3 February 2025. It draws exclusively on the IHRA working definition of antisemitism, which represents one amongst many different options, notably the Jerusalem Declaration on Antisemitism<\/a> and the NEXUS Definition of Antisemitism<\/a>. The IHRA working definition has been extensively and repeatedly criticized by a wide range of scholars and experts, including legal experts. It has been found to be legally imprecise and unsuited for addressing and countering antisemitism. It is also known to be instrumentalized for repressing public debate, academic work and artistic expression.\u00a0<\/p>\\n

We are deeply concerned that the reliance on this working definition in the context of the documenta will lead to political censure and discrimination of artists and curators, especially those who are Palestinian, but also those who are Jewish and\/or Israeli. We predict that using the IHRA definition as the sole framework for identifying antisemitism will jeopardize artistic freedom of expression and ultimately contradict documenta\u2019s own mission. Considering these urgent concerns we kindly ask you to explain and reconsider the Code of Conduct\u2019s exclusive use of this definition. Please note that we shall publish this request also on our website.<\/p>\\n

This statement by KriSol provides a detailed and critical analysis of the resolution \u201eAntisemitismus und Israelfeindschaft an Schulen und Hochschulen entschieden entgegentreten sowie den freien Diskursraum sichern\u201c (Decisively counter antisemitism and hostility towards Israel at schools and universities and secure the free space for discourse), which is to be passed by the Bundestag on January 30. The text at hand is based on expert opinions, some of which have already been published, it expands and synthesizes them. We feel obliged to evaluate the parliamentary resolution because it directly and significantly affects the goals of our alliance, in particular the promotion of academic freedom and university autonomy, as well as the commitment to engaged, emancipatory and socially critical teaching and research and the facilitation of controversial debates. Much like the resolution on the protection of Jewish life, which was passed on November 7, 2024 and was criticized widely, this resolution was also developed and formulated with little transparency, excluding relevant parties from science, universities and schools. This opaque approach is mirrored in the parliamentary process: even members of the governing parties are unaware of the timing of the vote. With this statement we aim to provide the public, as well as political decision-makers and members of universities and schools, with a scientifically sound basis for assessing the resolution draft and its consequences. In principle its aim \u2013 to counter antisemitic discrimination and violence at schools and universities \u2013 is both necessary and correct. However, our assessment shows that the measures outlined in the proposal would fail to achieve the desired goal and would result in highly problematic interference in research, teaching, and school and university life. Our statement argues this along the following points:<\/span><\/p>\\n

  1. Isolated treatment of antisemitism\u00a0ignores other forms of discrimination, e.g. racism<\/span><\/li>\\n
  2. Focusing on Israel\u2019s history and present while neglecting the Middle East conflict and the history of Palestine and the historical complexity of the conflict is flawed<\/span><\/li>\\n
  3. Openness of discourse vs. securitization discourse - <\/span>the polarization and juxtaposition of positions, as well as the call for securitization, tend to narrow rather than open up spaces for discourse.<\/li>\\n
  4. Imminent threats to academic freedom \u2013 <\/span>are funding application project partners\u2019 private views to be investigated for potential breaches of German paradigms? What is considered evidence of antisemitism?<\/li>\\n

    Wir, Allianz f\u00fcr Kritische und Solidarische Wissenschaft, nehmen den Schutz Ihrer personenbezogenen Daten ernst und m\u00f6chten Sie an dieser Stelle \u00fcber den Datenschutz in unserem Verein informieren.<\/p>\\n

    Uns sind im Rahmen unserer datenschutzrechtlichen Verantwortlichkeit durch das Inkrafttreten der EU-Datenschutz-Grundverordnung (Verordnung (EU) 2016\/679; nachfolgend: \u201eDS-GVO\u201c) zus\u00e4tzliche Pflichten auferlegt worden, um den Schutz personenbezogener Daten der von einer Verarbeitung betroffenen Person (wir sprechen Sie als betroffene Person nachfolgend auch mit \u201eKunde\u201c, \u201eNutzer\u201c, \u201eSie\u201c, \u201eIhnen\u201c oder \u201eBetroffener\u201c an) sicherzustellen.<\/p>\\n

    Soweit wir entweder alleine oder gemeinsam mit anderen \u00fcber die Zwecke und Mittel der Datenverarbeitung entscheiden, umfasst dies vor allem die Pflicht, Sie transparent \u00fcber Art, Umfang, Zweck, Dauer und Rechtsgrundlage der Verarbeitung zu informieren (vgl. Art. 13 und 14 DS-GVO). Mit dieser Erkl\u00e4rung (nachfolgend: \u201eDatenschutzhinweise\u201c) informieren wir Sie dar\u00fcber, in welcher Weise Ihre personenbezogenen Daten von uns verarbeitet werden.<\/p>\\n

    Unsere Datenschutzhinweise sind modular aufgebaut. Sie bestehen aus einem allgemeinen Teil f\u00fcr jegliche Verarbeitung personenbezogener Daten und Verarbeitungssituationen, die bei jedem Aufruf einer Webseite zum Tragen kommen (A. Allgemeines) und einem besonderen Teil, dessen Inhalt sich jeweils nur auf die dort angegebene Verarbeitungssituation mit Bezeichnung des jeweiligen Angebots oder Produkts bezieht, insbesondere den hier n\u00e4her ausgestalteten Besuch von Webseiten (B. Besuch von Webseiten).<\/p>\\n

    Allgemeines<\/p>\\n

    (1) Begriffsbestimmungen<\/p>\\n

    Nach dem Vorbild des Art. 4 DS-GVO liegen dieser Datenschutzhinweise folgende Begriffsbestimmungen zugrunde:<\/p>\\n

    \u2013 \u201ePersonenbezogene Daten\u201c (Art. 4 Nr. 1 DS-GVO) sind alle Informationen, die sich auf eine identifizierte oder identifizierbare nat\u00fcrliche Person (\u201eBetroffener\\\") beziehen. Identifizierbar ist eine Person, wenn sie direkt oder indirekt, insbesondere mittels Zuordnung zu einer Kennung wie einem Namen, einer Kennnummer, einer Online-Kennung, Standortdaten oder mithilfe von Informationen zu ihren physischen, physiologischen, genetischen, psychischen, wirtschaftlichen, kulturellen oder sozialen Identit\u00e4tsmerkmalen identifiziert werden kann. Die Identifizierbarkeit kann auch mittels einer Verkn\u00fcpfung von derartigen Informationen oder anderem Zusatzwissen gegeben sein. Auf das Zustandekommen, die Form oder die Verk\u00f6rperung der Informationen kommt es nicht an (auch Fotos, Video- oder Tonaufnahmen k\u00f6nnen personenbezogene Daten enthalten).<\/p>\\n

    \u2013 \u201eVerarbeiten\u201c (Art. 4 Nr. 2 DS-GVO) ist jeder Vorgang, bei dem mit personenbezogenen Daten umgegangen wird, gleich ob mit oder ohne Hilfe automatisierter (dh technikgest\u00fctzter) Verfahren. Dies umfasst insbesondere das Erheben (dh die Beschaffung), das Erfassen, die Organisation, das Ordnen, die Speicherung, die Anpassung oder Ver\u00e4nderung, das Auslesen, das Abfragen, die Verwendung, die Offenlegung durch \u00dcbermittlung, die Verbreitung oder sonstige Bereitstellung, den Abgleich, die Verkn\u00fcpfung, die Einschr\u00e4nkung, das L\u00f6schen oder die Vernichtung von personenbezogenen Daten sowie die \u00c4nderung einer Ziel- oder Zweckbestimmung, die einer Datenverarbeitung urspr\u00fcnglich zugrunde gelegt wurde.<\/p>\\n

    \u2013 \u201eVerantwortlicher\u201c (Art. 4 Nr. 7 DS-GVO) ist die nat\u00fcrliche oder juristische Person, Beh\u00f6rde, Einrichtung oder andere Stelle, die allein oder gemeinsam mit anderen \u00fcber die Zwecke und Mittel der Verarbeitung von personenbezogenen Daten entscheidet.<\/p>\\n

    \u2013 \u201eDritter\u201c (Art. 4 Nr. 10 DS-GVO) ist jede nat\u00fcrliche oder juristische Person, Beh\u00f6rde, Einrichtung oder andere Stelle au\u00dfer dem Betroffenen, dem Verantwortlichen, dem Auftragsverarbeiter und den Personen, die unter der unmittelbaren Verantwortung des Verantwortlichen oder Auftragsverarbeiters befugt sind, die personenbezogenen Daten zu verarbeiten; dazu geh\u00f6ren auch andere konzernangeh\u00f6rige juristische Personen.<\/p>\\n

    \u2013 \u201eAuftragsverarbeiter\u201c (Art. 4 Nr. 8 DS-GVO) ist eine nat\u00fcrliche oder juristische Person, Beh\u00f6rde, Einrichtung oder andere Stelle, die personenbezogene Daten im Auftrag des Verantwortlichen, insbesondere gem\u00e4\u00df dessen Weisungen, verarbeitet (zB IT-Dienstleister). Im datenschutzrechtlichen Sinne ist ein Auftragsverarbeiter insbesondere kein Dritter.<\/p>\\n

    \u2013 \u201eEinwilligung\u201c (Art. 4 Nr. 11 DS-GVO) der betroffenen Person bezeichnet jede freiwillig f\u00fcr den bestimmten Fall, in informierter Weise und unmissverst\u00e4ndlich abgegebene Willensbekundung in Form einer Erkl\u00e4rung oder einer sonstigen eindeutigen best\u00e4tigenden Handlung, mit der die betroffene Person zu verstehen gibt, dass sie mit der Verarbeitung der sie betreffenden personenbezogenen Daten einverstanden ist.<\/p>\\n

    \u00a0<\/p>\\n

    (2) Name und Anschrift des f\u00fcr die Verarbeitung Verantwortlichen<\/p>\\n

    (3) Rechtsgrundlagen der Datenverarbeitung<\/p>\\n

    Von Gesetzes wegen ist im Grundsatz jede Verarbeitung personenbezogener Daten verboten und nur dann erlaubt, wenn die Datenverarbeitung unter einen der folgenden Rechtfertigungstatbest\u00e4nde f\u00e4llt:<\/p>\\n

    \u00a0<\/p>\\n

    \u2013 Art. 6 Abs. 1 S. 1 lit. a DS-GVO (\u201eEinwilligung\u201c): Wenn der Betroffene freiwillig, in informierter Weise und unmissverst\u00e4ndlich durch eine Erkl\u00e4rung oder eine sonstige eindeutige best\u00e4tigende Handlung zu verstehen gegeben hat, dass er mit der Verarbeitung der ihn betreffenden personenbezogenen Daten f\u00fcr einen oder mehrere bestimmte Zwecke einverstanden ist;<\/p>\\n

    \u2013 Art. 6 Abs. 1 S. 1 lit. b DS-GVO: Wenn die Verarbeitung zur Erf\u00fcllung eines Vertrags, dessen Vertragspartei der Betroffene ist, oder zur Durchf\u00fchrung vorvertraglicher Ma\u00dfnahmen erforderlich ist, die auf die Anfrage des Betroffenen erfolgen;<\/p>\\n

    \u2013 Art. 6 Abs. 1 S. 1 lit. c DS-GVO: Wenn die Verarbeitung zur Erf\u00fcllung einer rechtlichen Verpflichtung erforderlich ist, der der Verantwortliche unterliegt (z.\u2009B. eine gesetzliche Aufbewahrungspflicht);<\/p>\\n

    \u2013 Art. 6 Abs. 1 S. 1 lit. d DS-GVO: Wenn die Verarbeitung erforderlich ist, um lebenswichtige Interessen des Betroffenen oder einer anderen nat\u00fcrlichen Person zu sch\u00fctzen;<\/p>\\n

    \u2013 Art. 6 Abs. 1 S. 1 lit. e DS-GVO: Wenn die Verarbeitung f\u00fcr die Wahrnehmung einer Aufgabe erforderlich ist, die im \u00f6ffentlichen Interesse liegt oder in Aus\u00fcbung \u00f6ffentlicher Gewalt erfolgt, die dem Verantwortlichen \u00fcbertragen wurde oder<\/p>\\n

    \u2013 Art. 6 Abs. 1 S. 1 lit. f DS-GVO (\u201eBerechtigte Interessen\u201c): Wenn die Verarbeitung zur Wahrung berechtigter (insbesondere rechtlicher oder wirtschaftlicher) Interessen des Verantwortlichen oder eines Dritten erforderlich ist, sofern nicht die gegenl\u00e4ufigen Interessen oder Rechte des Betroffenen \u00fcberwiegen (insbesondere dann, wenn es sich dabei um einen Minderj\u00e4hrigen handelt).<\/p>\\n

    Die Speicherung von Informationen in der Endeinrichtung des Endnutzers oder der Zugriff auf Informationen, die bereits in der Endeinrichtung gespeichert sind, sind nur zul\u00e4ssig, wenn sie von einem der folgenden Rechtfertigungstatbest\u00e4nden gedeckt sind:<\/p>\\n

    \u2013\u00a0\u00a7 25 Abs. 1 TTDSG: Wenn der Endnutzer auf der Grundlage von klaren und umfassenden Informationen eingewilligt hat. Die Einwilligung hat gem. Art. 6 Abs. 1 S. 1 lit. a DS-GVO zu erfolgen;<\/p>\\n

    \u2013\u00a0\u00a7 25 Abs. 2 Nr. 1 TTDSG: Wenn der alleinige Zweck die Durchf\u00fchrung der \u00dcbertragung einer Nachricht \u00fcber ein \u00f6ffentliches Telekommunikationsnetz ist oder<\/p>\\n

    \u2013 \u00a7 25 Abs. 2 Nr. 2 TTDSG: Wenn die Speicherung oder der Zugriff unbedingt erforderlich ist, damit der Anbieter eines Telemediendienstes einen vom Nutzer ausdr\u00fccklich gew\u00fcnschten Telemediendienst zur Verf\u00fcgung stellen kann.<\/p>\\n

    \u00a0<\/p>\\n

    F\u00fcr die von uns vorgenommenen Verarbeitungsvorg\u00e4nge geben wir im Folgenden jeweils die anwendbare Rechtsgrundlage an. Eine Verarbeitung kann auch auf mehreren Rechtsgrundlagen beruhen.<\/p>\\n

    \u00a0<\/p>\\n

    (4) Datenl\u00f6schung und Speicherdauer<\/p>\\n

    F\u00fcr die von uns vorgenommenen Verarbeitungsvorg\u00e4nge geben wir im Folgenden jeweils an, wie lange die Daten bei uns gespeichert und wann sie gel\u00f6scht oder gesperrt werden. Soweit nachfolgend keine ausdr\u00fcckliche Speicherdauer angegeben wird, werden Ihre personenbezogenen Daten gel\u00f6scht oder gesperrt, sobald der Zweck oder die Rechtsgrundlage f\u00fcr die Speicherung entf\u00e4llt. Eine Speicherung Ihrer Daten erfolgt grunds\u00e4tzlich nur auf unseren Servern in Deutschland, vorbehaltlich einer ggf. erfolgenden Weitergabe nach den Regelungen in A. (7) und A. (8).<\/p>\\n

    Eine Speicherung kann jedoch \u00fcber die angegebene Zeit hinaus im Falle einer (drohenden) Rechtsstreitigkeit mit Ihnen oder eines sonstigen rechtlichen Verfahrens erfolgen oder wenn die Speicherung durch gesetzliche Vorschriften, denen wir als Verantwortlicher unterliegen (zB \u00a7 257 HGB, \u00a7 147 AO), vorgesehen ist. Wenn die durch die gesetzlichen Vorschriften vorgeschriebene Speicherfrist abl\u00e4uft, erfolgt eine Sperrung oder L\u00f6schung der personenbezogenen Daten, es sei denn, dass eine weitere Speicherung durch uns erforderlich ist und daf\u00fcr eine Rechtsgrundlage besteht.<\/p>\\n

    \u00a0<\/p>\\n

    (5) Datensicherheit<\/p>\\n

    Wir bedienen uns geeigneter technischer und organisatorischer Sicherheitsma\u00dfnahmen, um Ihre Daten gegen zuf\u00e4llige oder vors\u00e4tzliche Manipulationen, teilweisen oder vollst\u00e4ndigen Verlust, Zerst\u00f6rung oder gegen den unbefugten Zugriff Dritter zu sch\u00fctzen (zB TLS-Verschl\u00fcsselung f\u00fcr unsere Webseite) unter Ber\u00fccksichtigung des Stands der Technik, der Implementierungskosten und der Natur, des Umfangs, des Kontextes und des Zwecks der Verarbeitung sowie der bestehenden Risiken einer Datenpanne (inklusive von deren Wahrscheinlichkeit und Auswirkungen) f\u00fcr den Betroffenen. Unsere Sicherheitsma\u00dfnahmen werden entsprechend der technologischen Entwicklung fortlaufend verbessert.<\/p>\\n

    (6) Zusammenarbeit mit Auftragsverarbeitern<\/p>\\n

    Wie bei jedem gr\u00f6\u00dferen Verein, setzen auch wir zur Abwicklung unseres Gesch\u00e4ftsverkehrs externe in- und ausl\u00e4ndische Dienstleister ein (zB f\u00fcr die Bereiche IT, Logistik, Telekommunikation, Vertrieb und Marketing). Diese werden nur nach unserer Weisung t\u00e4tig und wurden iSv Art. 28 DS-GVO vertraglich dazu verpflichtet, die datenschutzrechtlichen Bestimmungen einzuhalten.<\/p>\\n

    Sofern personenbezogene Daten von Ihnen durch uns an unsere Tochtergesellschaften weitergegeben werden oder von unseren Tochtergesellschaften an uns weitergegeben werden (zB zu werblichen Zwecken), geschieht dies aufgrund von bestehenden Auftragsverarbeitungsverh\u00e4ltnissen.<\/p>\\n

    (7) Voraussetzungen der Weitergabe von personenbezogenen Daten in Drittl\u00e4nder<\/p>\\n

    Im Rahmen unserer Gesch\u00e4ftsbeziehungen k\u00f6nnen Ihre personenbezogenen Daten an Drittgesellschaften weitergegeben oder offengelegt werden. Diese k\u00f6nnen sich auch au\u00dferhalb des Europ\u00e4ischen Wirtschaftsraums (EWR), also in Drittl\u00e4ndern, befinden. Eine derartige Verarbeitung erfolgt ausschlie\u00dflich zur Erf\u00fcllung der vertraglichen und gesch\u00e4ftlichen Verpflichtungen und zur Pflege Ihrer Gesch\u00e4ftsbeziehung zu uns (Rechtsgrundlage ist Art. 6 Abs. 1 lit b oder lit. f jeweils iVm Art. 44\u2009ff. DS-GVO). \u00dcber die jeweiligen Einzelheiten der Weitergabe unterrichten wir Sie nachfolgend an den daf\u00fcr relevanten Stellen.<\/p>\\n

    Einigen Drittl\u00e4ndern bescheinigt die Europ\u00e4ische Kommission durch sog. Angemessenheitsbeschl\u00fcsse einen Datenschutz, der dem EWR-Standard vergleichbar ist (eine Liste dieser L\u00e4nder sowie eine Kopie der Angemessenheitsbeschl\u00fcsse erhalten Sie hier: https:\/\/ec.europA. eu\/info\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions_en). In anderen Drittl\u00e4ndern, in die ggf. personenbezogene Daten \u00fcbertragen werden, herrscht aber unter Umst\u00e4nden wegen fehlender gesetzlicher Bestimmungen kein durchg\u00e4ngig hohes Datenschutzniveau. Soweit dies der Fall ist, achten wir darauf, dass der Datenschutz ausreichend gew\u00e4hrleistet ist. M\u00f6glich ist dies \u00fcber bindende Unternehmensvorschriften, Standard-Vertragsklauseln der Europ\u00e4ischen Kommission zum Schutz personenbezogener Daten gem. Art. 46 Abs. 1, 2 lit. c DS-GVO (die Standard-Vertragsklauseln von 2021 sind verf\u00fcgbar unter https:\/\/eur-lex.europA. eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32021D0915&locale-en), Zertifikate oder anerkannte Verhaltenskodizes.<\/p>\\n

    \u00a0<\/p>\\n

    (8) Keine automatisiere Entscheidungsfindung (einschlie\u00dflich Profiling)<\/p>\\n

    Wir haben nicht die Absicht, von Ihnen erhobene personenbezogene Daten f\u00fcr ein Verfahren zur automatisierten Entscheidungsfindung (einschlie\u00dflich Profiling) zu verwenden.<\/p>\\n

    (9) Keine Verpflichtung zur Bereitstellung personenbezogener Daten<\/p>\\n

    Wir machen den Abschluss von Vertr\u00e4gen mit uns nicht davon abh\u00e4ngig, dass Sie uns zuvor personenbezogene Daten bereitstellen. F\u00fcr Sie als Kunde besteht grunds\u00e4tzlich auch keine gesetzliche oder vertragliche Verpflichtung, uns Ihre personenbezogenen Daten zur Verf\u00fcgung zu stellen; es kann jedoch sein, dass wir bestimmte Angebote nur eingeschr\u00e4nkt oder gar nicht erbringen k\u00f6nnen, wenn Sie die daf\u00fcr erforderlichen Daten nicht bereitstellen. Sofern dies im Rahmen der nachfolgend vorgestellten, von uns angebotenen Produkte ausnahmsweise der Fall sein sollte, werden Sie gesondert darauf hingewiesen.<\/p>\\n

    (10) Gesetzliche Verpflichtung zur \u00dcbermittlung bestimmter Daten<\/p>\\n

    Wir k\u00f6nnen unter Umst\u00e4nden einer besonderen gesetzlichen oder rechtlichen Verpflichtung unterliegen, die rechtm\u00e4\u00dfig verarbeiteten personenbezogenen Daten f\u00fcr Dritte, insbesondere \u00f6ffentlichen Stellen, bereitzustellen ( Art. 6 Abs. 1 S. 1 lit. c DS-GVO).<\/p>\\n

    (11) Ihre Rechte<\/p>\\n

    Ihre Rechte als Betroffener bez\u00fcglich Ihrer verarbeiteten personenbezogenen Daten k\u00f6nnen Sie uns gegen\u00fcber unter den eingangs unter A. (2) angegebenen Kontaktdaten jederzeit geltend machen. Sie haben als Betroffener das Recht:<\/p>\\n

    \u2013 gem\u00e4\u00df Art. 15 DS-GVO Auskunft \u00fcber Ihre von uns verarbeiteten Daten zu verlangen.     The Alliance for Critical Scholarship in Solidarity is a platform by and for people working in universities, research and cultural institutions. It develops infrastructures to protect academic freedom and university autonomy.
    In recent years, academic discourse has faced growing hostility, while research has increasingly had to defend itself against external interference. Members of universities, research and cultural institutions are experiencing more and more intimidation and public defamation. This endangers universities as places for science-based, controversial and pluralistic debates.<\/p>\\n

    In the face of these developments and the strengthening of right-wing extremist parties and positions, the alliance provides collectively developed resources to strengthen democratic procedures and to defend fundamental rights \u2013 including networking among individuals and exchange with academic and civil society institutions and organizations, peer counseling, compiled information resources, advocacy and public relations work for academic freedom, and the documentation of repression.<\/p>\\n

    The alliance relies on the commitment of its members to create a network of solidarity that leaves room for the heterogeneity of political positions as well as for the diverse cultures of different fields of study. The alliance sees itself as an autonomous organization, critical of discrimination, advocating for intersectional approaches and the dismantling of academic hierarchies. In resistance against the securitization of universities and carceral logics, the discrediting of empirical knowledge and the vilification of fields of teaching and research, as well as the exclusion and disadvantage of vulnerable individuals and groups, the alliance practices critical scholarship in solidarity.<\/p>\\n

    The Alliance for Critical Scholarship in Solidarity is open to members of universities, research and cultural institutions, as well as to individuals from other fields of work that are committed to the goals of the association (\u2198 statutes<\/a>). The Alliance was founded in response to the growing repression against critical scholarship in Germany, Austria and Switzerland as well as elsewhere. Its members encompass academics, artists, and lawyers. We advocate for emancipatory and critical teaching and research that facilitate open debates in institutions of higher education and beyond.\u00a0<\/p>\\n

    Given this remit we are very alarmed by the \u201cCode of Conduct of documenta and Museum Fridericianum gGmbH\u201d which was published on 3 February 2025. It draws exclusively on the IHRA working definition of antisemitism, which represents one amongst many different options, notably the Jerusalem Declaration on Antisemitism<\/a> and the NEXUS Definition of Antisemitism<\/a>. The IHRA working definition has been extensively and repeatedly criticized by a wide range of scholars and experts, including legal experts. It has been found to be legally imprecise and unsuited for addressing and countering antisemitism. It is also known to be instrumentalized for repressing public debate, academic work and artistic expression.\u00a0<\/p>\\n

    We are deeply concerned that the reliance on this working definition in the context of the documenta will lead to political censure and discrimination of artists and curators, especially those who are Palestinian, but also those who are Jewish and\/or Israeli. We predict that using the IHRA definition as the sole framework for identifying antisemitism will jeopardize artistic freedom of expression and ultimately contradict documenta\u2019s own mission. Considering these urgent concerns we kindly ask you to explain and reconsider the Code of Conduct\u2019s exclusive use of this definition.     This statement by KriSol provides a detailed and critical analysis of the resolution \u201eAntisemitismus und Israelfeindschaft an Schulen und Hochschulen entschieden entgegentreten sowie den freien Diskursraum sichern\u201c (Decisively counter antisemitism and hostility towards Israel at schools and universities and secure the free space for discourse), which is to be passed by the Bundestag on January 30. The text at hand is based on expert opinions, some of which have already been published, it expands and synthesizes them. We feel obliged to evaluate the parliamentary resolution because it directly and significantly affects the goals of our alliance, in particular the promotion of academic freedom and university autonomy, as well as the commitment to engaged, emancipatory and socially critical teaching and research and the facilitation of controversial debates. Much like the resolution on the protection of Jewish life, which was passed on November 7, 2024 and was criticized widely, this resolution was also developed and formulated with little transparency, excluding relevant parties from science, universities and schools. This opaque approach is mirrored in the parliamentary process: even members of the governing parties are unaware of the timing of the vote. With this statement we aim to provide the public, as well as political decision-makers and members of universities and schools, with a scientifically sound basis for assessing the resolution draft and its consequences. In principle its aim \u2013 to counter antisemitic discrimination and violence at schools and universities \u2013 is both necessary and correct. However, our assessment shows that the measures outlined in the proposal would fail to achieve the desired goal and would result in highly problematic interference in research, teaching, and school and university life. Our statement argues this along the following points:<\/span><\/p>\\n

    1. Isolated treatment of antisemitism\u00a0ignores other forms of discrimination, e.g. racism<\/span><\/li>\\n
    2. Focusing on Israel\u2019s history and present while neglecting the Middle East conflict and the history of Palestine and the historical complexity of the conflict is flawed<\/span><\/li>\\n
    3. Openness of discourse vs. securitization discourse - <\/span>the polarization and juxtaposition of positions, as well as the call for securitization, tend to narrow rather than open up spaces for discourse.<\/li>\\n
    4. Imminent threats to academic freedom \u2013 <\/span>are funding application project partners\u2019 private views to be investigated for potential breaches of German paradigms? What is considered evidence of antisemitism?<\/li>\\n
    5. Exclusive focus on the IHRA working definition, prescription of a controversial definition within fields examining it<\/span><\/li>\\n

      This final session will focus on the implications of the silencing of Palestine for democracy, with a particular focus on Germany. Since October 7, the impossibility of a human rights and international law-based approach to Palestine has grown at the same time as the space for criticism of Israeli state actions has shrunk. Concerns have been raised about the infringement by the German state on basic rights such as academic freedom and freedom of expression. Panelists will discuss some of the characteristics of the current silencing of Palestine in Germany and in German academia, the role of the German state and other actors, together with the implications of this for (German) democracy.<\/p>\\n

      \u2013 \u201eVerantwortlicher\u201c (Art. 4 Nr. 7 DS-GVO) ist die nat\u00fcrliche oder juristische Person, Beh\u00f6rde, Einrichtung oder andere Stelle, die allein oder gemeinsam mit anderen \u00fcber die Zwecke und Mittel der Verarbeitung von personenbezogenen Daten entscheidet.<\/p>\\n

      \u2013 \u201eDritter\u201c (Art. 4 Nr. 10 DS-GVO) ist jede nat\u00fcrliche oder juristische Person, Beh\u00f6rde, Einrichtung oder andere Stelle au\u00dfer dem Betroffenen, dem Verantwortlichen, dem Auftragsverarbeiter und den Personen, die unter der unmittelbaren Verantwortung des Verantwortlichen oder Auftragsverarbeiters befugt sind, die personenbezogenen Daten zu verarbeiten; dazu geh\u00f6ren auch andere konzernangeh\u00f6rige juristische Personen.<\/p>\\n

      \u2013 \u201eAuftragsverarbeiter\u201c (Art. 4 Nr. 8 DS-GVO) ist eine nat\u00fcrliche oder juristische Person, Beh\u00f6rde, Einrichtung oder andere Stelle, die personenbezogene Daten im Auftrag des Verantwortlichen, insbesondere gem\u00e4\u00df dessen Weisungen, verarbeitet (zB IT-Dienstleister). Im datenschutzrechtlichen Sinne ist ein Auftragsverarbeiter insbesondere kein Dritter.<\/p>\\n

      \u2013 \u201eEinwilligung\u201c (Art. 4 Nr. 11 DS-GVO) der betroffenen Person bezeichnet jede freiwillig f\u00fcr den bestimmten Fall, in informierter Weise und unmissverst\u00e4ndlich abgegebene Willensbekundung in Form einer Erkl\u00e4rung oder einer sonstigen eindeutigen best\u00e4tigenden Handlung, mit der die betroffene Person zu verstehen gibt, dass sie mit der Verarbeitung der sie betreffenden personenbezogenen Daten einverstanden ist.<\/p>\\n

      (3) Rechtsgrundlagen der Datenverarbeitung<\/p>\\n

      Von Gesetzes wegen ist im Grundsatz jede Verarbeitung personenbezogener Daten verboten und nur dann erlaubt, wenn die Datenverarbeitung unter einen der folgenden Rechtfertigungstatbest\u00e4nde f\u00e4llt:<\/p>\\n

      \u2013 Art. 6 Abs. 1 S. 1 lit. e DS-GVO: Wenn die Verarbeitung f\u00fcr die Wahrnehmung einer Aufgabe erforderlich ist, die im \u00f6ffentlichen Interesse liegt oder in Aus\u00fcbung \u00f6ffentlicher Gewalt erfolgt, die dem Verantwortlichen \u00fcbertragen wurde oder<\/p>\\n

      \u2013 Art. 6 Abs. 1 S. 1 lit. f DS-GVO (\u201eBerechtigte Interessen\u201c): Wenn die Verarbeitung zur Wahrung berechtigter (insbesondere rechtlicher oder wirtschaftlicher) Interessen des Verantwortlichen oder eines Dritten erforderlich ist, sofern nicht die gegenl\u00e4ufigen Interessen oder Rechte des Betroffenen \u00fcberwiegen (insbesondere dann, wenn es sich dabei um einen Minderj\u00e4hrigen handelt).<\/p>\\n

      Die Speicherung von Informationen in der Endeinrichtung des Endnutzers oder der Zugriff auf Informationen, die bereits in der Endeinrichtung gespeichert sind, sind nur zul\u00e4ssig, wenn sie von einem der folgenden Rechtfertigungstatbest\u00e4nden gedeckt sind:<\/p>\\n

      \u2013\u00a0\u00a7 25 Abs. 1 TTDSG: Wenn der Endnutzer auf der Grundlage von klaren und umfassenden Informationen eingewilligt hat. Die Einwilligung hat gem. Art. 6 Abs. 1 S. 1 lit. a DS-GVO zu erfolgen;<\/p>\\n

      \u2013\u00a0\u00a7 25 Abs. 2 Nr. 1 TTDSG: Wenn der alleinige Zweck die Durchf\u00fchrung der \u00dcbertragung einer Nachricht \u00fcber ein \u00f6ffentliches Telekommunikationsnetz ist oder<\/p>\\n

      \u2013 \u00a7 25 Abs. 2 Nr. 2 TTDSG: Wenn die Speicherung oder der Zugriff unbedingt erforderlich ist, damit der Anbieter eines Telemediendienstes einen vom Nutzer ausdr\u00fccklich gew\u00fcnschten Telemediendienst zur Verf\u00fcgung stellen kann.<\/p>\\n

      F\u00fcr die von uns vorgenommenen Verarbeitungsvorg\u00e4nge geben wir im Folgenden jeweils die anwendbare Rechtsgrundlage an. Eine Verarbeitung kann auch auf mehreren Rechtsgrundlagen beruhen.<\/p>\\n

      \u00a0<\/p>\\n

      (4) Datenl\u00f6schung und Speicherdauer<\/p>\\n

      F\u00fcr die von uns vorgenommenen Verarbeitungsvorg\u00e4nge geben wir im Folgenden jeweils an, wie lange die Daten bei uns gespeichert und wann sie gel\u00f6scht oder gesperrt werden. Soweit nachfolgend keine ausdr\u00fcckliche Speicherdauer angegeben wird, werden Ihre personenbezogenen Daten gel\u00f6scht oder gesperrt, sobald der Zweck oder die Rechtsgrundlage f\u00fcr die Speicherung entf\u00e4llt. Eine Speicherung Ihrer Daten erfolgt grunds\u00e4tzlich nur auf unseren Servern in Deutschland, vorbehaltlich einer ggf. erfolgenden Weitergabe nach den Regelungen in A. (7) und A. (8).<\/p>\\n

      Eine Speicherung kann jedoch \u00fcber die angegebene Zeit hinaus im Falle einer (drohenden) Rechtsstreitigkeit mit Ihnen oder eines sonstigen rechtlichen Verfahrens erfolgen oder wenn die Speicherung durch gesetzliche Vorschriften, denen wir als Verantwortlicher unterliegen (zB \u00a7 257 HGB, \u00a7 147 AO), vorgesehen ist. Wenn die durch die gesetzlichen Vorschriften vorgeschriebene Speicherfrist abl\u00e4uft, erfolgt eine Sperrung oder L\u00f6schung der personenbezogenen Daten, es sei denn, dass eine weitere Speicherung durch uns erforderlich ist und daf\u00fcr eine Rechtsgrundlage besteht.<\/p>\\n

      (5) Datensicherheit<\/p>\\n

      Wir bedienen uns geeigneter technischer und organisatorischer Sicherheitsma\u00dfnahmen, um Ihre Daten gegen zuf\u00e4llige oder vors\u00e4tzliche Manipulationen, teilweisen oder vollst\u00e4ndigen Verlust, Zerst\u00f6rung oder gegen den unbefugten Zugriff Dritter zu sch\u00fctzen (zB TLS-Verschl\u00fcsselung f\u00fcr unsere Webseite) unter Ber\u00fccksichtigung des Stands der Technik, der Implementierungskosten und der Natur, des Umfangs, des Kontextes und des Zwecks der Verarbeitung sowie der bestehenden Risiken einer Datenpanne (inklusive von deren Wahrscheinlichkeit und Auswirkungen) f\u00fcr den Betroffenen.       (6) Zusammenarbeit mit Auftragsverarbeitern<\/p>\\n

      Wie bei jedem gr\u00f6\u00dferen Verein, setzen auch wir zur Abwicklung unseres Gesch\u00e4ftsverkehrs externe in- und ausl\u00e4ndische Dienstleister ein (zB f\u00fcr die Bereiche IT, Logistik, Telekommunikation, Vertrieb und Marketing). Diese werden nur nach unserer Weisung t\u00e4tig und wurden iSv Art. 28 DS-GVO vertraglich dazu verpflichtet, die datenschutzrechtlichen Bestimmungen einzuhalten.<\/p>\\n

      Sofern personenbezogene Daten von Ihnen durch uns an unsere Tochtergesellschaften weitergegeben werden oder von unseren Tochtergesellschaften an uns weitergegeben werden (zB zu werblichen Zwecken), geschieht dies aufgrund von bestehenden Auftragsverarbeitungsverh\u00e4ltnissen.<\/p>\\n

      (7) Voraussetzungen der Weitergabe von personenbezogenen Daten in Drittl\u00e4nder<\/p>\\n

      Im Rahmen unserer Gesch\u00e4ftsbeziehungen k\u00f6nnen Ihre personenbezogenen Daten an Drittgesellschaften weitergegeben oder offengelegt werden. Diese k\u00f6nnen sich auch au\u00dferhalb des Europ\u00e4ischen Wirtschaftsraums (EWR), also in Drittl\u00e4ndern, befinden. Eine derartige Verarbeitung erfolgt ausschlie\u00dflich zur Erf\u00fcllung der vertraglichen und gesch\u00e4ftlichen Verpflichtungen und zur Pflege Ihrer Gesch\u00e4ftsbeziehung zu uns (Rechtsgrundlage ist Art. 6 Abs. 1 lit b oder lit. f jeweils iVm Art. 44\u2009ff. DS-GVO). \u00dcber die jeweiligen Einzelheiten der Weitergabe unterrichten wir Sie nachfolgend an den daf\u00fcr relevanten Stellen.<\/p>\\n

      Einigen Drittl\u00e4ndern bescheinigt die Europ\u00e4ische Kommission durch sog. Angemessenheitsbeschl\u00fcsse einen Datenschutz, der dem EWR-Standard vergleichbar ist (eine Liste dieser L\u00e4nder sowie eine Kopie der Angemessenheitsbeschl\u00fcsse erhalten Sie hier: https:\/\/ec.europA. eu\/info\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions_en). In anderen Drittl\u00e4ndern, in die ggf. personenbezogene Daten \u00fcbertragen werden, herrscht aber unter Umst\u00e4nden wegen fehlender gesetzlicher Bestimmungen kein durchg\u00e4ngig hohes Datenschutzniveau. Soweit dies der Fall ist, achten wir darauf, dass der Datenschutz ausreichend gew\u00e4hrleistet ist. M\u00f6glich ist dies \u00fcber bindende Unternehmensvorschriften, Standard-Vertragsklauseln der Europ\u00e4ischen Kommission zum Schutz personenbezogener Daten gem. Art. 46 Abs. 1, 2 lit. c DS-GVO (die Standard-Vertragsklauseln von 2021 sind verf\u00fcgbar unter https:\/\/eur-lex.europA. eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32021D0915&locale-en), Zertifikate oder anerkannte Verhaltenskodizes.<\/p>\\n

      \u00a0<\/p>\\n

      (8) Keine automatisiere Entscheidungsfindung (einschlie\u00dflich Profiling)<\/p>\\n

      Wir haben nicht die Absicht, von Ihnen erhobene personenbezogene Daten f\u00fcr ein Verfahren zur automatisierten Entscheidungsfindung (einschlie\u00dflich Profiling) zu verwenden.<\/p>\\n

      (9) Keine Verpflichtung zur Bereitstellung personenbezogener Daten<\/p>\\n

      Wir machen den Abschluss von Vertr\u00e4gen mit uns nicht davon abh\u00e4ngig, dass Sie uns zuvor personenbezogene Daten bereitstellen. F\u00fcr Sie als Kunde besteht grunds\u00e4tzlich auch keine gesetzliche oder vertragliche Verpflichtung, uns Ihre personenbezogenen Daten zur Verf\u00fcgung zu stellen; es kann jedoch sein, dass wir bestimmte Angebote nur eingeschr\u00e4nkt oder gar nicht erbringen k\u00f6nnen, wenn Sie die daf\u00fcr erforderlichen Daten nicht bereitstellen. Sofern dies im Rahmen der nachfolgend vorgestellten, von uns angebotenen Produkte ausnahmsweise der Fall sein sollte, werden Sie gesondert darauf hingewiesen.<\/p>\\n

      Ihre Rechte als Betroffener bez\u00fcglich Ihrer verarbeiteten personenbezogenen Daten k\u00f6nnen Sie uns gegen\u00fcber unter den eingangs unter A. (2) angegebenen Kontaktdaten jederzeit geltend machen. Sie haben als Betroffener das Recht:<\/p>\\n

      \u2013 gem\u00e4\u00df Art. 15 DS-GVO Auskunft \u00fcber Ihre von uns verarbeiteten Daten zu verlangen.       \u2013 gem\u00e4\u00df Art. 20 DS-GVO Ihre Daten, die Sie uns bereitgestellt haben, in einem strukturierten, g\u00e4ngigen und maschinenlesbaren Format zu erhalten oder die \u00dcbermittlung an einen anderen Verantwortlichen zu verlangen (\u201eDaten\u00fcbertragbarkeit\u201c);<\/p>\\n

      \u2013 gem\u00e4\u00df Art. 21 DS-GVO Widerspruch gegen die Verarbeitung einzulegen, sofern die Verarbeitung aufgrund von Art. 6 Abs. 1 S. 1 lit. e oder lit. f DS-GVO erfolgt. Dies ist insbesondere der Fall, wenn die Verarbeitung nicht zur Erf\u00fcllung eines Vertrags mit Ihnen erforderlich ist. Sofern es sich nicht um einen Widerspruch gegen Direktwerbung handelt, bitten wir bei Aus\u00fcbung eines solchen Widerspruchs um die Darlegung der Gr\u00fcnde, weshalb wir Ihre Daten nicht wie von uns durchgef\u00fchrt verarbeiten sollen.
